In the most concerning cases, the invalid allegations are shared with professional registration bodies as potential misconduct before any investigation is completed, creating unnecessary reputational and professional risks. 

Case Study: Skipping Human Review Can Have Serious Consequences

At PCL Lawyers, we have assisted multiple clients facing allegations of academic misconduct during final assessments required for professional registration. 

In recent cases, candidates were accused of plagiarism and unauthorised AI use during exams based on standard facts and procedures. Because the assessment required candidates to demonstrate knowledge of common information, from a limited range of resources and where a specific process had to be followed, many responses naturally included similar language and structure. The AI-powered detection tool was prompted to detect similar content between candidates and to check against gen-AI sample answers. 

The providers’ systems flagged several of these responses, but no human review occurred before both the students and the professional body overseeing registration were notified of misconduct concerns. 

At a summary level, the evidence did look compelling. By reviewing the detection reports and applying our detailed understanding of how AI-powered plagiarism detection tools work, we were able to help our clients demonstrate that the allegations were unfounded. The similarities in the responses were to be expected based on the design of the assessment. The real issues were the misapplication of the detection tool and the absence of a fair review process.
