Franchise Disputes in Brisbane

When act for both franchisors and franchisees. We therefore understand both perspectives. A few of the types of franchise disputes in which we have experience are:

  • Franchising Code Disputes
  • Franchise Agreement / Disclosure Document Disputes
  • Breach of the Franchise Agreement
  • Misrepresentation Claims
  • Notices of Dispute
  • Default Notices.

Given that we draft, amend and review franchise agreements and disclosure documents, we know them inside out. In handling disputes, we are experienced in the intricacies of various types of franchise agreement and understand the complexities involved in applying the Franchising Code (the Code). We understand the nuances of the Franchising Code and the responsibilities of franchisors and franchisees within that framework.

We also provide advice with disputes that reflect our understanding of the commercial aspects of the franchising model, operations, and other agreements such as supply agreements that impact a franchise business. This combined knowledge is extremely helpful in approaching disputes between franchisors and franchisees.

We respond to default notices, liaise with the franchisor on the franchisee’s behalf, and issue notices of dispute. We seek to resolve a dispute where appropriate and having a buffer, such as an experienced franchise lawyer, is always very helpful to a franchisee to negotiate a reasonable outcome, including upon exiting the franchise. Otherwise, we enforce franchisees’ rights – for example, where the franchisee has been misled about the franchise when induced to buy.

Our lawyers in Brisbane issue breach / default notices and enforce franchisor rights. Our firm also represents franchisors who face allegations of various types, including from franchisees and regulatory bodies such as the ACCC. Our extensive knowledge of the entire franchise process, from drafting to franchise conclusion, gives us a competitive advantage in advocating for our franchisor clients.

We can assist in the following ways:

  • by providing your preliminary advice in relation to your circumstances
  • formally setting out your position to the other party, with the view to a quick resolution of the dispute
  • acting for you at mediation
  • if the dispute is not resolved at mediation, and litigation is necessary, representing you in court
  • dealing with any urgent court applications, for example an injunction, where immediate action is required.
