What approach will we take to your property dispute?

The approach we take will depend on the type of your property dispute. However, most disputes start with a letter being drafted, after we have taken detailed instructions and fully understand the merits of your case.

If you are the initiating party, a letter to the other party will set out your position. The tone of the letter will be anything from a request for further information or expressing a desire to negotiate to a strong legal letter of demand threatening legal proceedings, if the demands of the letter are not met.

If you are on the receiving end of strong correspondence from another party or their solicitors, we take the same approach, only in reverse. We will listen to your side of the story, assess the allegations that have been made against you and then prepare an appropriate response to the other party’s lawyers. We see many claims that are without a proper basis and we will advise the other side if there are weaknesses in their client’s case.

Property Litigation Is it Necessary or Inevitable?

If a dispute can’t be resolved or if a party has a strong case, then court or QCAT proceedings are usually an inevitable outcome.

We will try to negotiate with another party where possible, having regard to your objectives. If negotiations don’t work, which is typically dependent upon the attitude of the other party, we will commence legal proceedings on your behalf. Legal proceedings are not always as intimidating as what many think. Legal proceedings will engage the other party and make them face the issues.

What Benefit is Mediation in a Property Dispute?

There is always an opportunity for at least one mediation in legal proceedings. Mediation is a formal alternative to dispute resolution and an excellent way to bring the parties together, sitting around a table, usually with legal representation. A mediator will chair the mediation. Mediators typically take an interventionist approach to outlining the various strengths and weaknesses of each party’s arguments. Many property disputes are settled at mediation, without the need for the parties to go to trial.

Being well represented at, and prior to, mediation can help the property dispute to settle earlier.

Urgent circumstances
